"It certainly caught most off guard and has been a lively last month with individuals scrambling to protect assets and earn justice thru the legal channels." said Mike Bromell, a Texan, who had spent a month working a half dozen auto surfing programs before events unfolded that has drawn national attention.

StormPay is based in Clarksville, Tennessee and was founded in 2002 and served as a payment intermediary for online auction sites and other Internet businesses such as 12DailyPro and Alien Trust, 2 auto surfing programs Bromell was active with. "The concept is similar to the television advertising model in that companies would allow me to stay at home and surf a minimum number of websites daily and earn a certain percentage of money each day based on the purchase of advertising units. At the end of January my account and the accounts of thousands from across the world were frozen via StormPay and the fight to protect our assets is on in many countries." In the first part of February the BBB in Clarksville received over 18,000 complaints regarding StormPay and the complaints have spread to the point of authorities such as the FBI becoming involved.

To help associates across the world try and retrieve funds, Bromell and his partner have unveiled a program that will help promote the recent activities involving StormPay as well a method for eventually to recoup financial loses. "Listen, I don't have all the facts and I hope this issue is resolved," said Bromell, "but I know a lot of folks that were hurt emotionally and financially. A 3rd party payment processor can not freeze funds, change their TOS agreements and threaten folks for legally doing charge backs with their credit card company. Enough is enough and we have a simple method that folks should enjoy."

Stormygear.com debuted on February 22nd and has a simple concept. "In sports, you don't get mad, you get even," said Bromell. "and we are giving folks an opportunity to let others know about the activities of StormPay and at the same time earn some money back for the hit many took recently." Cure For Mesothelioma Aided By $1 Million of Research Funding

New Research Grants Continue Progress Against Dread Cancer
 
Mesothelioma Applied Research Foundation Announces Additional $1 Million of Research Funding
 
SANTA BARBARA, Calif., Feb. 23 /PRNewswire/ -- The Mesothelioma Applied Research Foundation ("MARF") announced today awards of almost $1 million in additional research funding aimed at curing mesothelioma ("meso").  An international and cross disciplinary set of nine new projects will go forward thanks to grants from MARF of $100,000 each.  Researchers in Holland, Australia and the United States combined their efforts to field a broad spectrum of investigative efforts that are certain to advance the pace and scope of research success against this deadly cancer.  Meso is a malignant tumor related to asbestos exposure that aggressively invades the mesothelial linings of the lungs, abdomen, heart, or testicles.
 
MARF's scientific experts selected the nine projects as the most important and promising among 28 high caliber applications received from around the world.  For each of these two-year projects, the researchers are bound by strict budgeting and progress reporting requirements.  Funds for the first year were paid in late 2005 and the research is now underway.
 
In a Phase I clinical trial focused on immune therapy, Doctor B.N.M. Lambrecht of the Erasmus Medical Center in Rotterdam, the Netherlands, plans to evaluate dendritic cells as a therapeutic adjuvant for treating malignant meso in humans.  This grant follows up on previous successes with immunotherapy studies in mice that were very effective and also funded by MARF.  Dendritic cells proved capable of generating an immune response when presenting meso tumor antigens and the current study intends to test the feasibility and safety of this approach.
 
Hot on the heels of meso-specific serum biomarker announcements in late 2004 and early 2005, researchers at USC under the direction of Dr. Ite Laird-Offringa were given a grant to continue investigating diagnostic markers for meso.  USC plans to use DNA microarray chips to pre-screen 6500 serum markers using the MethyLight analytical system.  Tissue samples would be examined to identify specific molecular markers found in meso tumor specimens with an eye to developing new serum tests to aid early diagnosis of the cancer.
 
The molecular understanding of the human genome has allowed researchers to undertake much more precise and tactical interventions against meso. Professor Xiaobo Cao of Texas A&M University, and his team, received a grant to investigate a specific gene family bcl-2, known to over-express a protein BCL-XL which blocks cell death (apoptosis) in mesothelioma tumors. Researchers wish to evaluate a bcl-2/bcl-xl antagonist, a compound that blocks the actions of the over-expressed protein, to see if it will cause tumor cell death and sensitize meso cells to the effects of existing chemotherapy agents. Such studies were virtually impossible ten years ago and represent the leading edge of scientific research today.
 
A Nevada Cancer Institute team under the direction of Dr. Sunil Sharma will continue its investigation of suberoylanilide hydroxamic acid (SAHA), a histone deacetylase (HDAC) inhibitor.  SAHA and other HDLC inhibitors have demonstrated broad cancer activity and provide a promising new approach to therapy.  Tumor resistance to HDAC inhibitors will be studied in an effort to identify combination therapies with mTOR inhibitors and nutrient uptake inhibitors that can increase tumor response to treatment.  Dr. Sharma intends to generate a meso cell line resistant to SAHA and other drugs like valproic acid and then compare them to parent cell lines using molecular analysis to identify markers of resistance.  These markers will then become targets for therapy.
 
MARF funded five other, equally innovative and important studies in this latest round of grants.  Some of these research grants will become stepping stones; used to provide sufficient data to propose and win larger research grants from the National Institute of Health (NIH) and other government agencies.  Using this approach, MARF-funded projects have had a multiplier effect on the total research investment into a cure for mesothelioma.  Taken together, these studies have achieved, and will continue to achieve, results far in excess of what MARF could have accomplished alone.  Without MARF's investment, however, little progress would have taken place.

Two large U.S. Postal Service (USPS) mail-processing centers in California are now home to major energy-efficiency improvements with the completion of a unique hybrid alternative power plant -- combining two solar technologies and hydrogen fuel cell generation -- announced by Chevron Corp.
"This project demonstrates the value of combining energy efficiency and clean energy technology. The savings created by new, efficient equipment at these facilities are helping to pay for clean, alternative energy -- solar and hydrogen fuel cell power."

Chevron Energy Solutions, a Chevron subsidiary, developed, engineered and constructed the new energy management upgrades. At the 680,000-square-foot facility Processing & Distribution Center (P&DC), Chevron Energy Solutions installed a hybrid solar/fuel cell power plant composed of a 250-kW Direct FuelCell that generates electricity from hydrogen produced internally from natural gas; 185 kW of crystalline-silicon solar panels mounted on a PowerLight parking canopy that tracks the sun; and 100 kW of flexible, amorphous-silicon, roof-mounted Uni-Solar solar panels.

The improvements at both facilities will lower total annual electricity purchases by $1.2 million or 10 million kilowatt hours (kWh) -- a 46 percent reduction. In addition, the energy-efficient equipment will reduce the P&DC's and Embarcadero Postal Center's (EPC) heating needs by 69 percent and 28 percent, respectively. In total, these improvements translate to a reduction in local electric utility emissions of about 6,600 tons of carbon dioxide annually, the equivalent of planting about 1,860 acres of trees.

"This project demonstrates the value of combining energy efficiency and clean energy technology," said Jim Davis, president of Chevron Energy Solutions (CES). "The savings created by new, efficient equipment at these facilities are helping to pay for clean, alternative energy -- solar and hydrogen fuel cell power. We commend the Postal Service for implementing a comprehensive, cost-effective solution that meets operating needs, improves the employees' work space and benefits the environment."

Together, the mail facilities -- the P&DC and EPC -- comprise 1.2 million square feet, employ about 3,000 people and process 7.5 million pieces of mail daily, operating around the clock. The USPS is the largest employer in San Francisco's Bay View/Hunter's Point district, where the P&DC is located.

The $15 million cost of the project is wholly funded by $8.3 million in energy savings, $4 million from the USPS's CFC refrigerant replacement program, and nearly $2.6 million in grants and incentives from the state of California and the U.S. Department of Defense Climate Change Fuel Cell Program.

Further the P&DC was presented with a rebate check for $2.3 million by Pacific Gas and Electric Company, which administers incentive programs for self-generation and efficiency improvements in Northern and Central California.

The San Francisco project is part of a larger USPS contract with Chevron Energy Solutions to install energy-efficiency improvements at mail facilities throughout Northern California. CES recently completed improvements at the USPS processing facility in West Sacramento and is upgrading facilities in Oakland, Berkeley, San Jose, Stockton, Salinas and other Northern California locations. Together, these improvements will save the USPS more than $2 million per year in energy costs. In addition, CES has installed improvements at the USPS's Memphis, Tenn., mail-processing facilities.

Seizures of Canadian Drugs Endangering Patients

 
FDA Seizures of Canadian Drugs Unnecessarily Endangering U.S. Patients

Recent interdictions of Canadian drug packages by U.S. Customs agents are part of a calculated campaign to intimidate patients who order life-saving medications from licensed online Canadian Pharmacies. Interruptions in established medical therapy are putting patients at unnecessary risk.

Calgary, Canada (PRWEB) February 13, 2006 -- The U.S. FDA has been ramping-up interdictions of Canadian drug packages in what appears to be an intentional intimidation campaign timed to coincide with the launch of the controversial Medicare Part D prescription drug program. Seizure rates at major border entry points have increased nearly ten-fold since December and are accompanied by a letter that obviously intends to frighten patients. Computer Users Hidden Data Returns From The Dead

Hidden Data Haunting Computer Users

BOSTON -- When the New England Journal of Medicine used a word-processing function to reveal that Merck had deleted study data about Vioxx and heart attacks, the pharmaceutical giant joined a long line of organizations bitten by information lurking in electronic files.

It's happened to organizations from the Pentagon to the British prime minister's office.

Each time, making minor electronic adjustments to documents aired juicy details not meant for public disclosure -- such as the true author of a file or sensitive data hacked from a final draft.

The pitfalls of such hidden "metadata" have long been known in computer-savvy circles, but these high-profile leaks are driving new efforts to keep a lid on metadata. So sensitive is the topic for the U.S. government that the National Security Agency released guidance in December on how agencies can properly redact reports.

For the corporate world, several companies are finding success in selling tools to automatically scan for and remove metadata.

Metadata is data about data. A word-processing document, for instance, has metadata on who authored it, when someone saved it and what that person did to it. Microsoft's Word program has a "track changes" feature that preserves a file's original text and shows another person's edits. All that is metadata.

This information is designed to stick around because it can help people organize their files and collaborate with one another.

But because it doesn't show up when a document is printed and doesn't appear on screen in normal settings, it's easy to forget about.

Fears about the hazards of metadata led Microsoft to pull back on a planned feature in Vista, the upcoming Windows operating system. Originally, Vista was going to let users drag and drop files into spots on the desktop in order to label documents with personalized categories.

But Vista testers told Microsoft it might become "a little too easy" to apply the categories and have them stick permanently to the document, said Mike Burk, a Windows product manager. That could get ugly if a file labeled "projects I hate" were e-mailed to a boss.

Meanwhile, the next generation of Microsoft's widely used Office software, which includes Word, Excel and PowerPoint, will make it simpler to strip metadata from files before they are disseminated.

Even so, Gartner analyst Michael Silver says the problem will remain -- metadata will exist in documents unless users make a point of getting rid of it.

"It's still a manual process. It's still something you have to remember to do," Silver said. "Any time you're relying on the user to remember something, there's a good chance that they'll forget."

The Pentagon had a hidden-data episode last May. Before posting a report in Adobe Systems' Portable Document Format about a U.S. soldier who had accidentally killed an Italian secret service agent in Iraq, officials covered up classified information with black bars.

But there's a difference between covering and deleting information. Readers simply uncloaked the text by cutting it from under the black and pasting it elsewhere.

Automated tools to help protect against metadata releases have existed for a while, but they are beginning to see wider use. For example, Workshare sells a product called Trace that scans documents for metadata and ranks the findings by risk level. For most of Workshare's six years in existence, the company's customers were primarily lawyers, who are particularly sensitive about client information escaping to the opposing side.

But in the past year, Workshare has seen business expand to 60 percent of the Fortune 1000, said CEO Joe Fantuzzi. Revenue has surpassed $25 million, and Fantuzzi believes metadata protection is on the verge of being a must-have for corporate technology buyers.

Richard Smith, a computer privacy expert at Boston Software Forensics, mined metadata to determine who in the British prime minister's office worked on a 2003 dossier on Iraq.

Even in a world more attuned to the perils of metadata, however, Smith doesn't think the material will dry up.

"There are simply too many people who work in governments around the world, and there is no way to educate them all about metadata," he wrote in an e-mail. "I expect to see a steady stream of slip-ups in the future."

American Filed Bankruptcy Petitions Offer CPA Opportunity

Flexibility Is Key With New Bankruptcy Laws

(openPR) - Last year Congress passed massive legislation that completely altered the playing field of bankruptcy proceedings for both individuals and corporations. The dust is just beginning to settle on the new bankruptcy rules, but already some opportunities for financial professionals have surfaced.

For example, a flexible means test to assess individuals' ability to repay their debts was part of the package. The formula takes into account whether the filer earns more than the state median income and can repay at least $100 a month of their unsecured debt over five years. Legitimate expenses such as food, shelter, clothing, medical care, transportation, attorneys' fees and charitable contributions are taken into account in the analysis.

However, the new law, which became effective October 17, has come under assault for being too restrictive, particularly in terms of the heavy paperwork and filing requirements that it involves. It was the first major revision to the bankruptcy laws since 1978.

According to records available, more than 500,000 Americans filed bankruptcy petitions in the two weeks prior to the date when the new provisions took effect. This compares to approximately 60,000 petitions filed in an average two-week period in previous years.

$295 Report Reveals Upheaval In Legal Records Management

 
Major Law Firms Employ Approximately 22 Employees in the Legal Records Division Per Lawyer Employed

Emerging Best Practices in Legal Records Management is based on detailed interviews with records and practice management professionals and partners at some of America’s most prestigious law firms, courts and law schools. They discuss their records management practices, and their current and future plans and policies.

(PRWEB) February 8, 2006 -- Major law firms employ approximately 22 employees in the Legal Records Division per lawyer employed, while smaller firms employ about nine per lawyer, according to Emerging Best Practices in Legal Records Management, a new study from Primary Research Group.

The study is based on detailed interviews with records and practice management professionals and partners at some of America’s most prestigious law firms, courts and law schools. Among the organizations profiled: Thompson Hine, Dewey Ballantine, Kay Scholer, Fulbright & Jawarski, The National Archives & Records Administration, Blackwell Sanders Peper Martin, the U.S. Court System for the District Courts, Thomas M. Cooley Law School and Darby & Darby.

The report reveals a great deal of upheaval in legal records management. Law firms and other organizations struggle to integrate new technologies such as RFID and comprehensive digital imaging of documents, as well as new philosophies emphasizing greater knowledge management skills and the integration and archiving of electronic records with paper archives.

Many of the organizations profiled were in the process of developing new document retention policies, and the report discusses their strategies and travails in this area of emerging importance and stress.

A minority of law firms, and the US Federal Court System, are moving ahead dramatically with records imaging. Firms that move forward often expect to spend more than $100,000 just to get started. The report describes their effort and relates their advice on equipment purchases, training, and explaining the issue to senior partners, among other issues.

Proponents of comprehensive digital imaging are often somewhat skeptical of the possibilities of RFID technology, saying that widespread digital imaging will obviate the need for it. However, RFID has many proponents and is on the wish list for many firms though perceived high costs seem to be discouraging more widespread use.

It is not only law firms that are moving forward with new information technologies. Indeed, Thomas Cooley law school describes how one of its legal clinics has automated much of the records and case management process. The National Archives and the US Federal Courts describe efforts to make digital records the official record of submission, displacing traditional paper formats.

The law firm department leaders in the sample tended to emphasize the importance of aggressively maintaining the reputation of the records department within the firm. Loss of reputation leads to loss of cooperation from others which then reduces the records department’s effectiveness which leads to further loss of reputation, etc, etc. Dramatic action may be necessary to restore reputation and reverse the downward spiral once the records department suffers a blow to its reputation, setting off the self reinforcing plunge into ineffectuality. Records departments can implode once they lose the trust of those they serve and regaining that trust needs to be aided by a firm but sympathetic law firm management.

Researchers with the Ischemic Researcher and Education Institute in California also found that Trasylol’s two generic alternatives—aminocaproic acid and tranexamic acid—did not pose these same risks of serious drug side effects. These generic medications are also much less expensive.

Experts believe that at least 10,000 patients are currently on dialysis to treat serious kidney failure caused by Trasylol. It is also estimated that if patients are treated with a generic alternative to Trasylol, over 11,000 kidney dialysis complications could be prevented and millions of dollars could be saved in healthcare and drug costs worldwide. The lead author of the study believes the risks associated with Trasylol clearly outweigh the drug’s intended benefits.

Support Grows for Ban on Male Circumcision

Bill proposals to regulate male circumcision now circulating in Congress and fifteen U.S. state legislatures.

San Diego, CA (PRWEB) February 7, 2006 -- John Soemer from New Jersey remembers the moment when he learned that a part of his penis was missing as if it were yesterday. “I am now 61 years old, but I was in fifth grade when I first found out I was circumcised,” recalled John. “I had seen an intact friend's penis when he relieved himself while we were out fishing, and when I asked him why his looked so different, he told me what had been done to me. Back then neither one of us knew the proper name for any of those parts, so he called his foreskin his ‘funskin’. That gave me enough of an idea that I was missing out on something, and left me feeling very cheated.”
   
John is not the only circumcised man who feels that he was robbed of his right to an intact body. While thousands of men are taking up foreskin restoration to reverse some of their circumcision damage, others are working with human rights groups to stop circumcision from being forced onto infants and children. Today, John and a group of activists from fifteen states joined this movement when they participated in the Third Annual USA MGM (Male Genital Mutilation) Bill Submission. Together they submitted letters and bill proposals via fax, email, postal mail, and hand delivery to more than 2,700 federal and state legislators in a single day – up from 660 legislators the year before. The proposed legislation, written by San Diego based MGMbill.org, would make current U.S. female genital mutilation laws gender neutral so that boys are legally protected from circumcision the same way that girls are protected.

Matthew Hess, President of MGMbill.org, said that infant circumcision is sexual assault. “Male circumcision permanently damages male sexual function, and it is done forcefully, without the consent of the child. Just as cutting off any part of a baby girl’s genital anatomy would be considered a criminal act, amputation of a boy’s foreskin for medically unnecessary reasons should be treated as a crime of equal stature. If a fully informed adult wants to undergo circumcision for cosmetic, religious, or other personal reasons, then that is a decision he can make after he turns eighteen.”

Chaz Antonelli of Quincy, Massachusetts, took a day off from work to hand out copies of the MGM Bill proposal to legislators at the State House in Boston. Like most American men born in the 1960’s, Chaz was routinely circumcised as an infant in a hospital. “As a newborn baby, I could not protect myself from being circumcised,” said Chaz. “While I support an adult’s right to alter his or her own genitals if that is their preference, forcing circumcision onto a helpless child is a clear human rights violation. I’m here today because I want Massachusetts to be the first U.S. state to ban routine infant male circumcision.”
   
Male circumcision legislation is also becoming a topic of discussion in several European parliaments. Sweden became the first developed country in modern times to regulate and restrict male circumcision on human rights grounds in 2001, and in 2003 the Denmark National Council for Children called on lawmakers to ban the practice for the benefit of the children. In 2004, well-known Dutch Member of Parliament Ayaan Hirsi Ali called on fellow legislators to enact a similar ban, and she recently stated on a Dutch television documentary that male circumcision is “a form of mutilation” and that “the consequences can be worse for boys than for girls” when compared to some common types of female circumcision.

In addition to all 540 members of Congress, state legislatures that received MGM Bill proposals from their local residents today included California, Florida, Louisiana, Maryland, Massachusetts, Missouri, Nebraska, New Jersey, New York, North Carolina, Oregon, South Carolina, Tennessee, Utah, and Virginia.

Super Bowl Advertisers Fumble Paid Search Engine Marketing Efforts

Each year, major media outlets review Super Bowl commercials and rate the good, the bad, and the ugly of the mix. Search engine marketing agency, SendTec, shares its analysis of how well each Super Bowl television advertiser prepared for the onslaught of enhanced web traffic from search engines.

(PRWEB) February 6, 2006 -- Market research indicates that advertisers see a direct correlation between their offline advertising spend and the amount of search engine queries against search terms associated with their brand, product or service. With this phenomenon as a backdrop, search engine marketing agency, SendTec, conducted an analysis of how well each Super Bowl television advertiser prepared for the onslaught of enhanced web traffic from search engines.

“What better venue to analyze this phenomenon of ‘offline to online’ than the Super Bowl,” said Eric Obeck, President of SendTec. “We were shocked to see how many advertisers spent millions of dollars on their Super Bowl TV commercial, yet did not spend a significant amount of time to make the most of the inevitable search engine traffic bound to follow.”

Each year, major media outlets review Super Bowl commercials and rate the good, the bad, and the ugly of the mix. The usual Super Bowl ad suspects are around such as Pepsi, Ameriquest, and Budweiser, along with internet upstarts like GoDaddy and newbie Positive Solutions. These polls / studies evaluate basic recall, creative appeal, and other metrics, but they fail to measure the impact of interaction with search engines and a search user’s ability to find the promotion online within Search Engine Results Pages (SERP’s).

“Over the past few years, we have been seeing a growing trend in Super Bowl advertising tying in with specialized online promotions, and 2006 continued the trend. More advertisers are trying to make the most of these extraordinarily expensive campaigns by giving them an ongoing life online,” said Obeck. “The television and the computer have become one with broadband acceptance, and more television watchers are “Googling” as a direct response to their television viewing experience. It is smart marketing to build out unique landing pages to tie online promotions to the original stimulus that drove them to search for it online.”

The crux of the study was to identify, during game time where ads are most expensive, the advertisers that created a unique online destination to communicate within the Super Bowl commercial. Upon identification, SendTec conducted an evaluation of their search engine visibility and ranking for both paid search and organic search listing in association with general ad recall. Finally, a review analyzed how well the online marketing communication in the search engine listing results tied with the offline marketing communications from the Super Bowl advertisement.

Overall, 16 advertisers included a special destination URL within their ads that tied to an online promotion. Of these special landing sites, a total of 6 showed up within relevant organic search results, and 5 showed up within relevant paid search results. Additionally, only three of these Super Bowl advertisers included marketing communications within their online ad copy that intelligently tied with the television promo.

“While traditional ad agencies are beginning to recognize the value of integrated online and offline marketing campaigns, they are still dropping the ball when it comes to execution.” extends Tim Daly, VP of Marketing Strategy at SendTec. “It is easy to sell an advertiser on a supporting website or micro site, whose cost is a drop in the bucket in comparison to the media cost associated with a Super Bowl commercial. Unfortunately, these agencies still do not seem to get the concept that a viewer cannot remember a specific URL within the 2-3 seconds it displays on the screen. They are leaving so much on the table by not applying paid search engine marketing activities around the concepts of the ad that consumers actually recall. And the loser in the end is the advertiser.”

The February edition of CancerWire focuses on the continued presence of a carcinogen that will stun many Americans - asbestos the well known carcinogenic mineral is still being used in the U.S. and this deadly mineral can be found in over 30 million homes and schools. These revelations and others were provided during a recent interview with Linda Reinstein of the Asbestos Disease Awareness Organization (ADAO).

Asbestos Diseases are Incurable

When her husband Alan was diagnosed with a deadly cancer (mesothelioma) which is caused by asbestos, Linda Reinstein decided to take a stand. She turned her anger into action and co-founded the Asbestos Disease Awareness Organization (ADAO). Today, ADAO is an international organization that has representatives throughout the world and offers support, resources and education for a growing community of patients and caregivers.

Ms. Reinstein wants more Americans to know about asbestos so they can protect themselves and avoid being diagnosed with an incurable disease like her husband. “Asbestos can cause or contribute to cancers such as mesothelioma, lung, larynx, esophageal, and stomach cancer and many non-malignant diseases such as asbestosis and chronic pulmonary respiratory disease. Ten thousand lives are lost in the U.S. every year to all asbestos-related disease. Each case is incurable and often deadly and every case could have been prevented because the dangers of this mineral were known in the early 1900's,” Ms. Reinstein explained. This enormous death toll may actually be under-reported because asbestos diseases are usually hard to diagnose. Many victims will die of cardiac failure or pneumonia and are never diagnosed with an asbestos related disease.

No Asbestos Ban?

In 1989, the EPA announced an asbestos ban and phase out. But in 1990, the ban was overturned by a U.S. Circuit Court of Appeals. “So we don't have an actual ban on asbestos, but instead a regulation to reduce exposure,” said Reinstein. “Asbestos is allowed in certain concentrations. For example, under OSHA, an employee cannot be exposed to more than 0.1 asbestos fibers per cubic centimeter of air for an average eight hour work day. But, this gets confusing because how does a consumer know if a given product fits within those guidelines?” According to Reinstein these regulations may not even matter because the EPA has repeatedly stated that there is no safe level of asbestos exposure.

In addition to having asbestos present in new products and materials, an estimated 30 million homes, schools and offices are already contaminated with the mineral. So construction, repair, or demolition in older structures can lead to exposure as we saw on 9/11 with the World Trade Center. “One life lost to an asbestos related disease is tragic; hundreds of thousands of lives lost is unconscionable. While we can't reclaim the lives of our loved ones, we can make the world a better place for those who come after us.” Reinstein concluded.

The action entitled : "Kathryn Fjeld v. Ibm, Isogon Corporation, Tetragon L.L.C., Steven Barritz, Robert Barritz, Peter Kassan, Per Helberg, David Vardi And Steven Youchnow" was filed under New York County Supreme Court Index No. 100071/2006 IBM, ISOGON and Long Island-based Tetragon, LLC, a software development firm and Syosset residents Steven Barritz and Robert Barritz have been sued by a former employee for sexual harassment and retaliatory discharge. Kathryn Fjeld, a former product manager for Isogon was terminated on April 15, 2005, after complaining of harassment and a barrage of bizarre, often sexually-charged e-mails, from Steven Barritz, a co-worker and son of Isogon principal Robert Barritz.

The suit claims damages of $10 million. Kathryn Fjeld, a former product manager for Isogon was terminated on April 15, 2005, after complaining of harassment and a barrage of bizarre, often sexually-charged e-mails, from Steven Barritz, a co-worker and son of Isogon principal Robert Barritz.

The action entitled : "Kathryn Fjeld v. Ibm, Isogon Corporation,
Tetragon L.L.C., Steven Barritz, Robert Barritz, Peter Kassan, Per Helberg, David Vardi And Steven Youchnow" was filed under New York County Supreme Court Index No. 100071/2006.

Ms. Fjeld, a product manager for Isogon had been recently touted by some in management as a future "CEO" of the company.

The complaint filed in New York County Supreme Court on January 4, 2006 details the pattern of demeaning and harassing conduct to which Ms. Fjeld was subject while employed at Isogon. Isogon was acquired and absorbed by IBM a few months after Ms. Fjeld was terminated. Isogon was aware of Ms. Fjeld's claim before the merger occurred.
       
As product manager Ms. Fjeld was often in contact with Steven Barritz and they had a friendly working relationship until Mr. Barritz began demanding a sexual relationship. Because defendant Steven Barritz had made it clear that he could cause plaintiff to lose her job, Ms. Fjeld was compelled to endure a continuous barrage of vulgar and sexually-humiliating advances and e-mails at the Isogon facilities. Said conduct created a hostile work environment. Ms. Fjeld retained digital copies of the offensive e-mail.

Ms. Fjeld was, and remains, married.

Despite working in the same office, Ms. Fjeld's job as a product manager for Isogon's VISTA and VISTA-PLUS were complicated by having to avoid contact with Steven Barritz. Her avoidance of the situation only made matters worse. Despite all the efforts of plaintiff to resist defendant Steven Barritz's advances, he persisted in making sexual advances. On Tuesday, November 12, 2004, angry that plaintiff had ignored his advances, Steven Barritz wrote in an e-mail: "Let's just say, I expect a phone call from you sometime this month. I also ask one other thing of you. That you let me know if you want to go to the dance thing on the 20th. Those are the two things I expect from you right now. I want a whole lot more, but, I'm trying to control myself, chill out, and re-direct this energy towards other parts of my life."

On November 5,2004 defendant Steven Barritz wrote plaintiff an e-mail which concluded with his disturbing opinion about the Mel Gibson film "Passion of the Christ": "PS Have you seen the Passion? It's great fun! You have to fast forward past the boring non-violent parts, of course. My favorite part is this one time they tear a huge chunk of flesh off near his rib cage. I almost came in my pants when they did that."

In a rambling message sent Tuesday, November 23, 2005, Steven Barritz wrote an e-mail stating:

"Maybe the reason you haven't called me about this, is because you don't want to be better friends with me. That's okay, I mean, you're certainly allowed to not be friends with me." Steven Barritz then added ominously "And friends or not, I'll still make sure you are treated right by Isogon, you don't have to worry about that."

At the end of the November 24, 2004 Steven Barritz sent an e-mail message with the following:

"PPS I think you should watch more porn." (Emphasis in the original)

Plaintiff continued to ask defendant Steven Barritz to stop e-mailing her. In response Ms.Fjeld responded via e-mail: "please do not write things like this to me." Instead, Steven Barritz increased the volume of offensive e-mails and in private conversations at Isogon's offices threatened to have her terminated from her job if she did not agree to spend more time with him.

Ms. Fjeld was unable to bear the continued harassment and informed defendant Steven Barritz that she would be making a formal complaint to Isogon management. In response, on February 20, 2005 Steven Barritz sent Karthryn Fjeld an e-mail with a 90 page attachment. It was the exit strategies manual for soon-to-be terminated Isogon executives: "From: Steve Barritz / Sent: Sunday, February 20, 2005 12:04 PM / To: Kathryn Fjeld / Subject: FW: the black book BP Exec Manual (for one on one).DOC " Executive Career Transition Counseling"" The threat was clear. If she complained about his advances then defendant Steven Barritz would use his access to his father to have her terminated.

Shortly after complaining to management about the conduct of Steven Barritz, Robert Barritz directed that she be terminated abruptly.

5 Ways You Can Avoid Costly Credit Card Late Fees

Credit card late fees are a fact of life for some consumers, but they don’t have to be for you. Legally, credit card companies can hit you with pretty much whatever fees they want. On the other hand, you don’t have to pay them, but only if you avoid them in the first place. Here are five sure fire ways you can avoid costly credit card late fees:

1. Pay Before the Due Date. Of course, this makes the most sense. However, this is also the single most important reason why people get socked with fees: they receive their bill and immediately forget about it! When you get your bill, open it up and pay it promptly. Waiting means forgetting and forgetting about your credit card bill will cost you money.

2. Pay on the Internet. If you have access to a computer, then paying online is the best way to make certain that your payment gets to your credit card provider on time. Be careful, as there is still some lag time from when you authorize funds to be released from your checking account and when that payment is finally credited to your credit card account. The gap between the two can be as long as one week!

3. Schedule Automatic Payments. Some credit card providers allow for you to set up a scheduled deduction from your checking account which is then automatically sent to your credit card provider. You should set it up to take money out of your account well before the due date to ensure that your funds are received on time. You can always send in a separate, extra payment if you want to pay down your debt faster too.

4. Question a Late Payment. Even if the credit card company claims that your payment was late, it doesn't mean that you must be charged a late fee. Contact the company and ask them to reverse their charge –- which usually runs between $29 and $39 -- and to expunge their records of your tardiness. You not only want to avoid any fees, you want to avoid their possible notification of your lateness to the three major credit report agencies [Experian, TransUnion, and Equifax]. Any information supplied to the credit reporting agencies can work against you in the form of higher interest rates on current cards as well as on future loans!

5. Go with the Citi Simplicity Credit Card. Now, consumers have a new option to help them avoid late fees: Citi’s new Citi Simplicity card doesn’t charge late fees. Please click the link below for more information about this breakthrough card.

  First-Ever National Public Service Announcement Campaign Addresses Growing Home Foreclosure Problem; Promotes 888-995-HOPE Help Hotline  

It's a national epidemic: Within the last five years alone, nearly 2.9 million households in the United States have experienced foreclosure.

To combat the nation's rising foreclosure problem, the Homeownership Preservation Foundation, a 501(c)(3) nonprofit organization is launching what may be the first-ever nationwide public service campaign to specifically address the nation's growing foreclosure problem. The campaign encourages homeowners to call the Foundation at 888-995-HOPE to receive free, confidential advice from HUD-certified counseling agencies. Based in Minneapolis, the Homeownership Preservation Foundation is dedicated to reducing foreclosures and preserving homeownership for American homeowners.

According to the Homeownership Preservation Foundation's president and executive director, Walt Fricke, there's plenty of blame to share for the nation's rising foreclosure problem, from homeowners who have not educated and informed themselves about the obligations of taking on a mortgage, to the availability of easy credit. Regardless, says Fricke, no one wins when a foreclosure touches a neighborhood.

"Besides the obvious loss to a homeowner and his or her family, the values of homes near foreclosed properties drop dramatically when a home is boarded up. A typical city may lose up to $33,000 per foreclosed home, and a typical mortgage company may lose $50,000 or more per home," says Fricke. "One way or another, all consumers suffer and end up paying more."

To drive awareness of the Foundation's toll-free hotline, the campaign will leverage two 30-second TV spots, two 15-second TV spots, three 60-second-radio spots and one 30-second radio spot, as well as two print executions. One of the radio spots specifically addresses the needs of homeowners affected by Hurricane Katrina; another radio spot is available in Spanish to reach Latino homeowners. The broadcast spots are being distributed to TV and radio stations throughout the United States beginning in January.

The theme of the campaign focuses on moving homeowners who are facing financial difficulties from a state of "denial" to taking action before it costs them their homes. In each television spot, an actor personifies the nagging, annoying thoughts that weigh on a homeowner who is experiencing financial difficulty. In one spot, an actor appearing as a blue-collar worker is screamed at incessantly as he goes through his daily motions at work. In the other PSA, a woman experiences her annoyance from the moment she wakes up, and it continues as she prepares to leave home for work.

"We've counseled more than 50,000 homeowners and we've learned that the earlier a homeowner acknowledges their financial difficulties and calls us, the more options we have in helping that homeowner," says Walt Fricke, president and executive director of the Homeownership Preservation Foundation. "By the time a homeowner actually has been served a foreclosure notice, there is sometimes little we can do."

Unfortunately, notes Fricke, based on industry data and a recent Harris Interactive survey of homeowners, slightly more than 50 percent of homeowners avoid contacting their mortgage company for help.

"Our campaign is designed to reach out to this 50 percent -- those who are uncomfortable calling their mortgage company," Fricke says.

The creative team included Dave Keepper, creative director; Glenn Gray, art director; and Brian Ritchie, copywriter. Biomet and EBI Spine Sued By Medtronic for Patent Infringement

Medtronic Sues Biomet and EBI Spine for Patent Infringement
 
MEMPHIS, Tenn.--(BUSINESS WIRE)--Feb. 1, 2006--Medtronic, Inc. (NYSE:MDT) announced today that its spinal business, Medtronic Sofamor Danek, Inc., has filed suit against Biomet Inc. and its subsidiary EBI Spine, L.P. for patent infringement. The suit, which involves seven Medtronic patents and seeks injunctive relief and monetary damages, was filed in the United States District Court for the District of New Jersey.

Three of the patents (6,916,320; 6,592,586; 6,428,542) were purchased by Medtronic in 2005 from Gary K. Michelson, M.D. and involve single-lock anterior cervical plating systems used in cervical spinal fusions. Medtronic claims that a cervical plate marketed by Biomet under the trade name VueLock(R) Anterior Cervical Plate System, and openly promoted as a plate that has a "Secure One Step Locking" mechanism feature, infringes these Michelson patents, now owned by Medtronic. In previous litigation, Biomet and its subsidiary Cross Medical, were found to infringe two different Medtronic cervical plate patents.

The other patents (5,810,878; 6,036,692; 6,440,133; 6,790,209) involve rod reducer instruments and surgical implantation methods commonly used in spinal surgeries to implant pedicle screws. Biomet's pedicle screw systems utilize a rod reducer instrument in a variety of lumbar and thoracic spinal fusion surgeries. Rod reducers are integral to modern spinal surgery, reducing operating room time, improving efficiency and enabling surgical corrections that would be unattainable without the device.
